Terms of Service

1. Acceptance of Terms

By accessing or using Honest Pitches ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. What We Are

Honest Pitches is a marketplace for creators to publish honest, transparent sales pitches ("Pitches"). We are not a seller, reseller, or guarantor of any product or service featured on the Platform. All transactions occur directly between you and the creator.

3. Creator Obligations

By publishing a Pitch, you agree that:

• All disclosures required by the FTC (and applicable law) are truthful, accurate, and prominently displayed.
• You have the right to make all claims in your Pitch.
• Any evidence URLs you provide must actually support the claims they accompany.
• You will promptly update your Pitch if circumstances change (e.g., price changes, product is discontinued).
• You will not publish pitches for illegal products or services.

4. Disallowed Content

The following are prohibited on the Platform:

• Pitches containing defamatory, obscene, or hateful content
• Products or services that violate applicable law
• Fake scarcity, fake reviews, or fabricated social proof
• Pitches that misrepresent the nature of the product
• Spam, automated posting, or bot-generated content

5. Platform Fees

Creators pay listing fees to publish Pitches on the Platform. Current pricing is available at /pricing. There is no platform fee on sales — all revenue from your external checkout goes directly to you.

6. Verified Creator Subscriptions

Verified Creator is a optional subscription that provides a verified badge, listing discounts, and other benefits. Subscriptions are billed monthly or annually via Stripe. You may cancel at any time; cancellations take effect at the end of the current billing period.

7. Intellectual Property

Creators retain all rights to their Pitch content. You grant the Platform a non-exclusive, worldwide, royalty-free license to display your Pitch on the Platform. You represent that your Pitch does not infringe the intellectual property rights of any third party.

8. Disclaimer — What We Are NOT

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT ENDORSE, VERIFY, OR GUARANTEE ANY PITCH OR PRODUCT. WE ARE NOT LIABLE FOR ANY CLAIMS ARISING FROM YOUR USE OF A PITCH OR PURCHASE OF A PRODUCT ADVERTISED ON THE PLATFORM. Always do your own due diligence before purchasing.

9. Limitation of Liability

To the fullest extent permitted by law, Honest Pitches and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any purchase made via a Pitch.

10. DMCA & Content Removal

We comply with the Digital Millennium Copyright Act. If you believe a Pitch infringes your copyright, submit a DMCA takedown notice to legal@honestpitches.com. We will act on valid notices within the time required by law.

11. Changes to Terms

We may update these Terms at any time. Updated Terms will be posted at this URL with a revised effective date. Continued use of the Platform after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the United States.
